A Page County grand jury indicted James Richard Daley, 70, for the abuse of a child. Daley was arrested July 16 following a joint investigation by the Luray Police Department and Page County Sheriff’s Office.
The grand jury re¬turned an indictment against Daley who serves as the pastor of Beth Eden Lutheran Church, on 12 counts of aggravated sexual battery of a minor younger than 13.
Sheriff John Thomas declined to say whether the 12 counts involved more than one victim as the investigation remained ongoing. The alleged victim’s sex, age or whether the youth was a member of Daley’s church has also been withheld so as not to identify the child.
According to court records the crimes took place in 2011 and 2012,
On Friday, deputies also charged Margaret Daley, 69, with misdemeanor failing to report sexual abuse involving a child and on a felony count of creating a dangerous environment for a child. She and James are married. According to Thomas, Margaret Daley operated a day care, which required her to report suspected abuse if she was aware it was taking place.
Both defendants are being held without bond at Page County Jail.
James Daley is scheduled to appear Aug. 7 in Page County Circuit Court for a bail hearing. No records were available for Margaret Daley, whose next appearance will be in Juvenile and Domestic Relations Court.
